February 16 Council of the Moscow Ossetian community announced its decision, which reads as follows: "We are appealing to all the Ossetians in Moscow to take part in a demonstration at the Ministry of Foreign Affairs of the Russian Federation in support of the demand to recognize the genocide of the Ossetian people under the regime of Gamsakhurdia - Saakashvili from 1990 to 2008."
The fact that, an object of the rally aggression is selected the Ministry of Foreign Affairs of the fraternal, allied state, which has saved the people of South Ossetia from genocide, which has recognized the independence of South Ossetia, is a serious political mistake.
Recognition of the genocide is a rule –making act and, as a consequence, the competence authority is the State Duma of the Russian Federation, but not the Russian Foreign Ministry.
The Russian authorities do not yet have legal grounds for the recognition of the genocide of the Ossetian people, because the genocide has not yet been recognized by South Ossetia itself.
First, the genocide of the Ossetian people should be recognized by the Republic of South Ossetia itself, not in the form of declarations, resolutions and analytical briefs, but as a full-fledged legislative act of the Parliament of the country.
It should be established a parliamentary committee on the economic, financial and demographic damage to South Ossetia by Georgia's aggression from 1989 to 2008. The Parliamentary Commission should attract a wide range of international experts, independent appraisers and the media.
The outcome of the parliamentary inquiry should be the adoption of the Law "On the genocide of the Ossetian people," which should include specific financial and political demands to Georgia. The Law "On the genocide of the Ossetian people" should become an effective tool for political pressure on Georgia, the legal basis for the recognition of the genocide of Ossetians by the international community. We repeat that South Ossetia must first recognize the genocide of the Ossetian people by adopting the appropriate regulations.
Following this, the Ossetian public representatives in Russia and in other countries of the world, including Moscow, should initially use the format of conferences with experts, politicians, diplomats of these countries, inter-parliamentary and inter-party relations and only then – the rally aggression on the part of the public.
Despite our position, we, the Moscow Ossetians, are ready to support any action to condemn the genocide of the Ossetian people, no matter who was the organizer. However, the objects of the rally must be either the embassy of the states that supported the national-chauvinist regime in Georgia, or representative offices of the international organizations, condemning Russia for recognition of South Ossetia and for the action "to force Georgia to peace", or the places of the recognized symbols of the struggle against fascism. It is our firm position.
We will not be able to support the action at the Russian Foreign Ministry, as we believe such action is undertaken in undue haste, an act harmful to the state of South Ossetia, causing damage to the country's political leadership. We believe that the action with the requirements to the Russian Foreign Ministry leads to confrontation with the Russian authorities and is in line with the policy of "turning back upon Russia." We should state with regret, that the leadership of the Moscow Ossetian Community has once againyielded to provocative initiatives of the various anti-Ossetian lobbies.
We offer to hold a Conference "On the Ossetian representation in Moscow" on February 22, 2013, where should be discussed the integration of efforts of representatives of the Ossetian public in Moscow to submit the public legislative initiative to the Parliament of the Republic of South Ossetia on the preparation of the Draft Law "On the genocide of the Ossetian people," and its early adoption. The Moscow Ossetian community could be of great assistance to the Parliament of South Ossetia to attract the expert community to assist in drawing up this bill.
We are ready to hold our conference at the Ossetian community office in Moscow and look forward to the good will of the leadership of the Moscow Ossetian community, the active participation in its work.
In case of failure of the Conference at the Moscow Ossetian community office, we propose to use for this any neutral territory, involving all the stakeholders in organization of the Conference and its work.
